Terms and conditions of sale

Article 1

Purpose

These terms and conditions of sale apply to all orders placed on by-natachabaco.com, and to made-to-measure orders placed remotely.

Placing an order implies acceptance of the terms in force on the day it is confirmed. They apply to consumers, that is, people buying for personal and not professional purposes.

This English version is provided for convenience. In case of any difference, the French version prevails.

Article 2

The seller

The site is published by By Natacha Baco, a sole proprietorship registered in France. Full details (identity, SIRET number, address, contact) are given in the legal notice.

Article 3

Products

By Natacha Baco offers:

• atelier creations: pieces designed and crafted in France by the designer;
• capsule pieces: limited editions offered on pre-order for a set period, then crafted once orders close;
• the designer's finds: pieces selected by the designer but not made by her, identified as such on their product page;
• made-to-measure and bespoke creations, made on request (article 6).

Each product is presented on its own page with its essential characteristics. Photographs are taken with care but are not contractual: colours may vary slightly from one screen to another. For printed fabrics such as wax, the placement of the pattern varies from piece to piece: each creation is unique.

Article 4

Prices

Prices are shown in euros. VAT not applicable, article 293 B of the French General Tax Code.

Delivery costs are added to the price. They are calculated according to the destination and the delivery method chosen, and shown before the order is confirmed.

By Natacha Baco may change its prices at any time; the price applied is the one displayed when the order is confirmed. For capsule pieces, the pre-order price applies only while the capsule is open.

Article 5

Ordering on the site

Before confirming, please check the details of your order: items, sizes, colours, quantities, address and total price.

Once your order is confirmed and payment accepted, you receive a confirmation email. The sale is final once payment has been received.

If an item turns out to be unavailable after your order, By Natacha Baco will let you know as soon as possible and refund the corresponding amount.

Pre-order (capsule pieces)

Payment is made when you pre-order. Your piece is crafted once the capsule closes; the planned shipping week is shown on the capsule page and on the product page; parcels leave throughout that week. An order containing both a capsule piece and another item is shipped in one parcel, according to the capsule schedule.

By Natacha Baco reserves the right to refuse an order in the event of an ongoing dispute with the person placing it.

An invoice can be provided on request.

Article 6

Made-to-measure and bespoke

Made-to-measure

Any creation of the Maison, made to your measurements and in the fabric of your choice. It is ordered by email or through the form on the site:

1. you receive the price of the requested creation;
2. once the price is accepted, measurements are taken at an appointment in Paris, or remotely with a measurement guide; the fabric is chosen from the catalogue of available fabrics;
3. By Natacha Baco sends you a written confirmation setting out the creation, fabric, price, delivery costs and timeline. For a remote order, full payment is then made by PayPal;
4. the order is final once payment is received.

Bespoke

A creation imagined for you, by appointment in Paris only. Terms (price, payment, schedule) are set out in writing at the first appointment.

As these creations are made to your measurements or specifications, they are not covered by the right of withdrawal (article 9).

Article 7

Payment

Payment is made online, securely, through PayPal:

• by card, without needing a PayPal account;
• with your PayPal account;
• by Apple Pay, depending on your device;
• in 4 interest-free instalments, when PayPal offers it, depending on your order amount and eligibility;
• with a By Natacha Baco gift card (article 11).

Your card details are sent in encrypted form to PayPal; By Natacha Baco never has access to them.

Article 8

Delivery

Preparation times

• atelier creations and the designer's finds: shipped within 10 working days of payment;
• capsule pieces: during the shipping week shown on the capsule page;
• remote made-to-measure: around 20 working days after the order is confirmed;
• bespoke: 20 to 30 working days on average from the first appointment, confirmed at that appointment.

Shipping

Orders are shipped by carrier, with tracking: an email gives you the tracking number as soon as your order ships. Rates and available delivery methods are detailed on the Delivery page and offered at checkout.

Two separate orders cannot be combined: delivery costs apply to each one.

Collection in Paris

In France, you can choose free collection in Paris. Once your order is ready, By Natacha Baco will contact you to arrange an appointment on a Saturday; the address is sent to you by email. The handover does not include a fitting. Your order is kept for 4 weeks from the agreed appointment; after that, it can be shipped to you once shipping costs have been paid.

Receiving your order

You are responsible for the delivery address you provide. If a parcel is returned because of an incorrect or incomplete address, or because it was not collected, the cost of reshipping is at your expense.

Please check your parcel on delivery. If anything is wrong (parcel opened or damaged), note it with the carrier and let By Natacha Baco know within 48 hours, with photos.

Outside the European Union

Customs duties and local taxes may apply on arrival; they are at your expense.

Article 9

Right of withdrawal and returns

Time limit

For items covered by the right of withdrawal, you have 14 days from receipt of your order to exercise this right, without giving any reason. Let By Natacha Baco know by email at contact@by-natachabaco.com, or using the withdrawal form below, before this period ends.

Sending the item back

The item must be sent back no later than 14 days after you have informed us, to the address sent to you by email. Return costs are at your expense.

Condition of the item

Items must be returned in their original condition: not worn beyond a simple try-on, not washed, not altered, with the brand tag attached and in their original packaging. Removing the tag, like any handling beyond what is needed to check the nature, characteristics and size of the item, may lead to a deduction corresponding to the loss of value.

Credit note or refund

Once the item has been received and checked, you choose between a credit note valid for 1 year on the whole site and a refund of the sums paid, in accordance with the law, using the original payment method. The refund may be withheld until the returned item has been received.

Exclusions

Creations made to your measurements or specifications, or personalised, including made-to-measure and bespoke creations, are not covered by the right of withdrawal, in accordance with article L.221-28 of the French Consumer Code.

Article 10

Legal guarantees

All pieces are covered by the legal guarantee of conformity (articles L.217-3 et seq. of the French Consumer Code) for 2 years from delivery, and by the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code).

If there is a defect, contact By Natacha Baco: the piece will be repaired or replaced, or otherwise refunded.

Article 11

Gift card

The gift card is valid for 1 year from purchase, on the whole site. It cannot be exchanged for cash or refunded, even in part.

Article 12

Personal data

The data collected is used only to process orders and to keep in touch with you. It is never sold or passed on to third parties, except to the service providers needed for your order (payment, delivery).

Article 13

Intellectual property

The whole site (texts, photographs, drawings, creations, designs, logo, brand name) is protected by copyright and design law. Any reproduction, in whole or in part, without prior written permission is prohibited and constitutes infringement.

Article 14

Disputes

These terms are governed by French law. If there is a problem, please contact By Natacha Baco first so we can find an amicable solution together.

Failing an agreement, you may refer the matter free of charge to a consumer mediator, whose details will be provided on request.
